A meeting has been arranged to discuss the disruption caused by bugler during their development of the Autobar House site – 9am Monday the 19.01.2015 Site Offices.

MINUTES FROM MEETING BETWEEN REGATTA POINT & BUGLER DEVELOPMENTS
ON 1ST DECEMBER 2014

- Bugler Working Hours Section 61
The noise allowance is 8:00hrs – 18:00hrs Monday to Friday and 8:00hrs – 13:00hrs Saturday. These are the hoursBugler are permitted to undertake works which create noise over and above what is the general accepted decibel allowance.The section 61 is subject to change, but Bugler must alert the council to this.There are numerous instances where Bugler have surpassed the 18:00 cut off point, the general reason being because of concrete pouring. This is a general occurrence for a majority of projects; once they have started a pour they cannot stop it until the entire pour is complete.
The majority of issues have stemmed from the late delivery of concrete to site due to traffic in the surrounding area.
This is frustrating from Regatta Point’s position in that Bugler do carry out noisy works past 18:00, but this is permitted as long as they alert the council of this.
If issues continue with noisy works after 18:00 hours then we have suggested that individual residents take this up with the council. However, complaining to the council may not change the situation as Bugler is a social housing/ council funded build.
A comment was raised in regards to the late night council electrical works carried out by Scottish Electricity, which in turn has nothing to do with Bugler, but Bugler is raising it as a serious issue with the council.
- Bugler new loading bay/delivery area outside west area of Regatta Point
The new loading bay/ delivery area outside Regatta Point on the pavement has been fully accepted by the Council therefore it is fully compliant with the Streetworks Act. The plan states that they will protect the pavement with road plates and divert pedestrians safely across the road as and when required. This means that their Section 61/ site parameter extends to this area. Therefore they are allowed to be “noisy” in this area from the hours of 8:00 – 18:00 hours.
The council have not taken in to consideration that this area is outside of our residents’ bedroom windows. Bugler are well within their rights to continue to receive deliveries and use this area as they wish for loading and unloading irrelevant of the noise it makes, as the council have not imposed a noise restriction upon this area.
Bugler have also confirmed that they are fully aware that the loading bay potentially blocks the bin store area and now assist the council bin men with removing waste when they arrive.
- Bugler Generator left on Regatta Point property
This impeded Regatta Point’s access routes. Bugler stated that this will not happen again, and the operative responsible for leaving the generator in this position has been penalised for his actions.
- Bugler hot works outside west area of Regatta Point
It was noted that Bugler carried out hot works within this area; this is permitted, however they must make sure that the hot works are protected with a perimeter of barriers surrounding the working area. These particular hot works were carried out to cut down the road plates to suit the pavement protection.
Bugler have confirmed there should be no further works (i.e. hot works/ cutting) carried out on the pavement loading area with the exception of loading and unloading and vehicle holding.
- Bugler Gantry Licence
It was noted that Regatta Point representatives have not seen the Gantry Licence.
The Gantry licence is in place, this has not been issued to Regatta Point but it is not Buglers position to do so. The council should have informed the local neighbourhood of any changes to the development, which include the changes to the logistics plan and also the Gantry licence and this has not happened.
Bugler are well within their rights to change the logistics plan, gantry and cabin offices set up as long as they consult the council and they approve all changes.
With the extension to the site cabin set up there is the potential of Sunday working with a partial road closure in place in order to lift further cabins in to position. The decision as to which day this will be done is wholly down to the council permitting the partial road closure. The date is still to be confirmed, but it is most likely to be a Sunday.
Disruption from Bugler development of Autobar House
It has become apparent over the last few weeks that Bugler, the developers of Autobar House, are causing significant disruption to residents at Regatta Point.
Not only did they erect a crane without permission but they have also:
- been working beyond the agreed hours generating unwanted noise and lighting,
- blocking access from the western fire exit,
- restricting access to the bins for residents and council alike
- damaging the footpath.
All of these disruptions are occurring on a regular basis.
The Directors are taking up these matters directly with Bugler but it is vital that we document our issues. In that spirit could resident who are impacted please make a note of the time and date and issue and take photographs if possible.
